Baraza la Habari Tanzania (MCT), Kituo cha Sheria na Haki za Binadamu, (LHRC), naMtandao wa Watetezi wa Haki za BinadamuTanzania(THRDC) leo Januari 11, 2017, wamefungua kesi ya kuipinga Sheria ya Huduma za Vyombo vya Habari namba 12 ya mwaka 2016, katika Mahakama ya Afrika Mashariki (EACJ).

Sheria hiyo ilipitishwa na Bunge la Jamhuri ya Muungano wa Tanzania Novemba 5, 2016 na kuridhiwa na Rais Novemba 16, 2016. Katika kufungua kesi hiyo, timu ya wanasheria Fulgence Massawe, Donald Deya, Jenerali Ulimwengu, Jebra Kambole, Francis Stolla na Mpale Mpoki, wanaziwakilisha taasisi hizo katika mahakama ya EACJ.

Washirika wanataka baadhi ya vifungu vya sheria hiyo ambavyo vinakandamiza uhuru wa habari na uhuru wa kujieleza vifutwe kwani vinakiuka matakwa ya Mkataba wa Jumuiya ya Afrika Mashariki ambazo zinataka nchi mwanachama kuzingatia na kulinda haki ambazo zimeelezwa katika mkataba huo kwenye Ibara 6(d) na 7(2).

Ibara ya 6(d) ya Mkataba wa Jumuiya ya Afrika Mashariki inahimza umuhimu wa kufuata kanuni za utawala bora, utawala wa kidemokrasia, utawala wa sheria, uwajibikaji, uwazi, haki kwa wote, usawa wa kijinsia na kulinda na kuheshimu haki za binadamu.

Halikadhalika, Ibara ya 7(2)ya Mkataba huo inaitaka nchi mwanachamakufuata na kuheshimu kanuni za utawala bora, ikiwa ni pamoja na kufuata kanuni za demokrasia, utawala wa sheria na haki kwa wote.

Kama ilivyo kwenye kifungu cha 8(1) (c), Tanzania inatakiwa kuchukua hatua za kuhakikisha haki zote zinazotajwa katika mkataba huo zinafuatwa na kutekelezwa.

Kwa mujibu wa walalamikaji katika kesi hii, Sheria ya Huduma za Vyombo vya Habari 2016 inafinya uhuru wa kujieleza na uhuru wa vyombo vya habari, ambayo ni msingi wa demokrasia, utawala wa sheria, uwajibikaji, uwazi na utawala bora.

Tanzania iliridhia mkataba huo Julai 7, 2000. Chini ya kifungu namba 23 cha mkataba huo, Mahakama imepewa mamlaka ya kutafsiri mkataba huo na kuhakikisha nchi wanachama wanaufuata na kuusimamia.
